These Terms of Use are an agreement between you and EARNEDU LLC, a Virginia limited liability company that operates the EARN platform at earnedu.com. By accessing or using EARN, you agree to these terms. If you do not agree, please do not use the platform.
About EARN
EARN (Engage. Achieve. Reflect. Navigate.) is a web-based student growth tracking platform designed for K–12 teachers and students in Virginia. Teachers upload Virginia Standards of Learning (SOL) benchmark assessment data to track student performance levels over time. Students access the platform to view their own academic growth data.
EARN is designed exclusively for use in K–12 educational settings and is subject to the Family Educational Rights and Privacy Act (FERPA) and the Children's Online Privacy Protection Act (COPPA). By using EARN, schools and districts agree to act as the authorized agent providing consent on behalf of students under COPPA. EARNEDU LLC operates as a school official under FERPA and processes student education records solely to provide academic growth tracking services.
Who Can Use EARN
EARN is intended for use by authorized K–12 teachers, students, and school administrators. By using EARN, you confirm that:
- You are accessing the platform for legitimate educational purposes
- If you are a student under 18, your school has authorized your use of the platform
- You will not access the platform through automated means, bots, or scripts
- You will not use the platform for any illegal or unauthorized purpose
- You will not share your login credentials or provide access to unauthorized users
EARN uses Google Sign-In for authentication. Access is limited to approved school email domains. We reserve the right to suspend or terminate access for any user who violates these terms.
Subscriptions
EARN is offered to K–12 schools and districts on an annual subscription basis. Subscriptions do not renew automatically. Prior to the end of each subscription period, EARNEDU LLC will contact the school or district administrator by email to discuss renewal and communicate pricing for the upcoming school year.
You may cancel your subscription at any time by contacting us at support@earnedu.com. Cancellations take effect at the end of the current paid term. We may adjust subscription pricing from time to time and will communicate any changes in advance.
Intellectual Property
EARN and all of its content — including source code, design, functionality, graphics, and text — are owned by EARNEDU LLC and protected by applicable copyright and intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use EARN solely for its intended educational purpose. You may not copy, reproduce, modify, reverse engineer, or commercially exploit any part of the platform without our express written permission.
Prohibited Activities
When using EARN, you agree not to:
- Use the platform for any purpose other than legitimate K–12 educational use
- Attempt to access another user's data or account
- Interfere with or disrupt the platform or its underlying infrastructure
- Upload or transmit viruses, malware, or any harmful code
- Scrape, harvest, or systematically extract data from the platform
- Attempt to reverse engineer or copy any part of the platform's software
- Use EARN to harass, harm, or collect information about other users
- Misrepresent your identity or affiliation when using the platform
Violations may result in immediate suspension or termination of access, and may be reported to appropriate authorities where required by law.
Privacy
Your use of EARN is also governed by our Privacy Policy, which is incorporated into these Terms of Use by reference. The Privacy Policy explains what data we collect, how we use it, and your rights regarding that data. We strongly encourage all users — and especially schools and districts — to review it.
Platform Availability
We do our best to keep EARN running smoothly, but we cannot guarantee uninterrupted availability. We may occasionally need to perform maintenance, updates, or address technical issues that result in temporary downtime. We will make reasonable efforts to minimize disruptions, especially during the school year.
EARNEDU LLC reserves the right to modify, suspend, or discontinue any part of the platform at any time. We are not liable for any inconvenience caused by temporary unavailability.
Disclaimer & Limitation of Liability
EARN is provided "as is" and "as available." While we take care to ensure the platform functions reliably and securely, EARNEDU LLC makes no warranties — express or implied — about the accuracy, completeness, or fitness of the platform for any particular purpose.
To the fullest extent permitted by law, EARNEDU LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the platform. In all cases, our total liability to you is limited to the amount you paid for your current subscription period.
Governing Law & Disputes
These Terms are governed by the laws of the Commonwealth of Virginia. Any disputes arising from your use of EARN will be resolved under Virginia law, without regard to conflict of law principles.
We ask that before pursuing any formal action, you contact us directly at support@earnedu.com so we can work to resolve the issue. If informal resolution is not possible, disputes will be submitted to binding arbitration under the rules of the American Arbitration Association, and conducted in Virginia Beach, Virginia.
Changes to These Terms
We may update these Terms of Use from time to time. When we do, we will update the "Last Updated" date at the top of this page. Continued use of EARN after changes are posted constitutes acceptance of the updated terms. We encourage schools and administrators to review this page periodically.
